These booking Terms and Conditions (“Terms”) apply to the Pre booking of TVSM ICE vehicles (petrol-powered) listed on the Pre Book Online page and form a legally binding agreement under the Information Technology Act, 2000, as amended, between You and TVS Motor Company Limited, a company registered under the Companies Act 1956 and having its registered offices at “Chaitanya”, No.12, Khader Nawaz Khan Road, Nungambakkam, Chennai-600 006 Chennai, hereinafter referred to as “TVSM”

For the purpose of these Terms, wherever the context so requires “You/Your” will mean any person who has agreed to place the Booking of TVSM ICE vehicle through the website. The term “We/Us/Our” will mean TVS Motor Company Limited.

Pre-Booking/Booking

By placing a pre booking/ booking with Us, you express Your intention to purchase the vehicle specified by You (“Vehicle”) and agree to be bound by these Terms. Your purchase of the Vehicle and delivery by Us will be subject to Your compliance with the Terms hereunder and other applicable laws, regulations, and guidelines. Booking is subject to availability of the chosen vehicle at dealership to nearest dealership to your address where the vehicle could be made available in time – the same shall be communicated to the customer beforehand.

Pre Booking/Booking and Full Payment Amounts

The pre -booking amount of INR 3100 for the selected vehicle as mentioned on TVSM website shall be paid by You through following the step-by-step process on this Site. This shall be a non-interest bearing and will confirm Your booking. The same shall be construed as an offer from your end and shall be adjusted against payment of the final Vehicle price by You before or at the time of delivery. Upon the receipt of the booking amount by TVSM, we shall communicate the acceptance of the Booking, however, the acceptance of the Booking is not construed as completion of the sale of the TVSM vehicle as it is subject to the payment of balance amount, documentation requirements terms and conditions for registering of the vehicle at the time of delivery from the dealership.

You will receive payment confirmation for booking via SMS and Email or will be communicated through relevant necessary communication channels regarding your pre-booking/booking details at the relevant step of the pre-booking/booking process. You agree, that you will have to comply the steps (including but not limited to selection of variant, adding of accessories, additional payment basis the final invoice value) to complete the booking upon the launch of the respective vehicle you have pre-booked in the stipulated period of time to avail priority delivery of the vehicle, by following the steps which will be communicated to you in time. You will also receive notification on DMS booking number and you will be contacted by the dealer to complete the invoicing process.

Price of the TVSM Vehicle

The Price displayed while booking on the TVSM website is only the ex-showroom price of the vehicle. The On-Road price is subject to insurance charges, registration charges, accessories charges etc. The final Vehicle price is the prevailing price as applicable on the date of delivery by paying the balance amount excluding the booking amount. The balance sale price (i.e. balance sale consideration) shall be paid directly to the dealer(s) notified by TVSM.

Ex-showroom price is indicative and may vary at the time of purchase. Ex-showroom price is inclusive of GST. Additional accessories need to be purchased at the dealership. The On-Road price is subject to insurance charges, registration charges, accessories charges etc. This will be paid by You at the dealership. You may request for receipt for the same from the dealership.

Please take note that TVSM is only receiving the Pre-Booking Amount as a facilitator to promote the sale between the TVSM dealer and You. The actual transaction of the sale is a contract between You and the TVSM Dealer to whom you shall be making the payment of balance sale price.

TVSM shall not be responsible for any non-receipt of the Booking Amount due to technical or other reasons in the payment gateway or banking network issues.

Vehicle Delivery

Vehicle will be delivered to you by the selected dealer after clearance of all the payment dues by You.

Cancellation/Refund

  1. Refunds on booking amounts will be made within 60 days of the date of cancellation.

  2. This amount is refundable till the point of making the full payment for purchasing the vehicle.

  3. Please note that once the full payment for the vehicle, including the accessories, has been made, the sale shall be deemed as complete, and cancellation or claim for any refund amount will not be possible.

  4. You can initiate the cancellation request for any vehicle booked online by visiting www.tvsmotor.com. No cancellation shall be permitted at the dealership.

    1. If the cancellation request is raised beyond 90 days of the date of booking, then You have to additionally send an email to prebookingcancellation@tvsmotor.com containing booking information along with Your bank account number, Bank and Branch IFSC code, a copy of cancelled cheque leaf which shows your name / Bank account number and IFSC code.

    2. After the cancellation request has been raised, it cannot be revoked back.

    3. You will not be charged with any cancellation charges for online booked vehicles except for Build To Order (BTO) vehicles. For BTO orders, cancellation charges are as below:

    4. our refund request will be initiated within 48 hours of your cancelled booking. This will only comprise the money that was paid to TVSM during the online booking procedure, excluding any appropriate cancellation fee.

    5. The issuer bank typically processes the refund within 7 to 10 business days after the refund was initiated.

    6. You will receive your refund in the same payment source that has been used to make your online vehicle booking. There are no provisions made for any cash refunds.

    7. If a cancellation request is made beyond 90 days from the date of booking, the refund will be processed manually. Such cancellation requests are not subject to the herein specified refund timeline.

  5. Assignment or Transfer

    6. You acknowledge and agree that Your booking is for delivery of Vehicle only to You and You will not transfer or assign rights granted to You under these Terms to any other third party.

  6. Collection of Information

    7. We may require certain information and documents from You for processing Your booking, complying with statutory requirements. You represent and warrant that all such information and documents will be true, complete and accurate. You will promptly notify Us of any change in the information provided to allow Us to update Our records. All collection, storage, use and disclosure of any information provided by You will be in accordance with Our Privacy Policy available at https://www.tvsmotor.com/privacy-policy

  7. Purchase Terms

    8. These Terms are applicable to the Booking of the Vehicle. You acknowledge that purchase of Vehicle will be subject to such additional terms and conditions as may be prescribed by Us including without limitation, the TVS General Terms and Conditions (collectively, the “Purchase Terms”). Such Purchase Terms are subject to change, and We recommend that You carefully read and understand all the prescribed Purchase Terms before proceeding with the purchase of the Vehicle and making the full payment.

  8. Limitation of Liability

    9. We will not be liable for any indirect, special, incidental or consequential damages arising out of or in connection with these Terms. Your sole and exclusive remedy and Our aggregate and cumulative liability for any material breach under these Terms will be limited to refund of the Booking Amount in the amount of valid cancellation.

  9. Disclaimer

    10. The Vehicle will in all material aspects be similar to the Vehicle presented or advertised in marketing or promotional campaigns. However, in view of Our endeavors to continuously innovate and improve Our products, We reserve the right to modify/alter the specifications, features and/or design of the Vehicle without prior notice and without any liability.

  10. Miscellaneous

  11. TVSM will not be responsible for any delay or failure to perform Our obligations under these Terms, where such delay or failure is due to any reasons beyond Our reasonable control.

  12. In the event any of these Terms is considered invalid or unenforceable, the legality and enforceability of remaining provisions will not be affected or impaired thereby. These Terms will be subject to the laws of India and any dispute hereunder will be subject to the exclusive jurisdiction of the courts at Bengaluru.

  13. TVS Motor #RestlessToRace Social Media Contest Guidelines and Terms & Conditions. Contest Guidelines:

  1. Eligibility: The contest is open to individuals who have successfully completed the pre-booking process for the new TVS motorcycle on the official TVS Motor website.

  2. Participation Period: The contest will run from [24th August 2023] to [5th September 2023], inclusive.

  3. Submission Requirements: To enter the contest, participants must:

    1. Create a public social media post (Facebook, Instagram, or Twitter) showcasing their excitement and restlessness to get their hands on the latest TVS motorcycle.

    2. Use the hashtag #RestlessToRace in the post's caption.

    3. Tag the verified official TVS Apache profile in the post.

    4. The post can include creative content such as photos, videos, or text that highlights the participant's enthusiasm for the new motorcycle.

  4. Winner Selection: The lucky winner will be selected at the discretion of TVS Motor Company based on the creativity, originality, and alignment with the campaign theme displayed in their social media post.

  5. Prize: The selected winner will receive an all-expenses-paid trip to the global launch event of the new TVS motorcycle in Thailand. The prize includes airfare, accommodation, and event access.

  6. Terms & Conditions:

    1. By participating in the contest, participants acknowledge and agree to comply with these guidelines and terms and conditions.

    2. The contest is not open to employees, family members, or affiliates of TVS Motor Company.

    3. Participants must ensure that their social media profiles are set to "public" during the contest period to allow the organizers to view their entries.

    4. Entries must be original and not infringe upon any third-party rights. Any plagiarized or copyrighted content will be disqualified.

    5. TVS Motor Company reserves the right to use participants' contest entries for promotional purposes across its official social media channels, website, and other marketing materials.

    6. Participants must be at least 18 years of age or have the consent of a legal guardian to enter the contest.

    7. The winner will be announced before 6th September 2023 via TVS Motor's official social media accounts and will also be contacted directly through the social media platform they used to participate.

    8. The selected winner must respond to the winner announcement within [X] hours to claim the prize. Failure to do so will result in disqualification, and an alternate winner will be chosen.

    9. The prize is non-transferable and cannot be exchanged for cash or other items.

    10. TVS Motor Company reserves the right to modify or cancel the contest at any time due to unforeseen circumstances or if deemed necessary.

    11. By entering the contest, participants release TVS Motor Company and its affiliates from any liability related to the contest or the prize.

    12. The contest and these terms and conditions are subject to India laws and regulations.
